Trump Administration Finalizes Majority of Performance Measure Rule
May 22, 2017
CO2 emission section not yet finalized
The Trump Administration has made final a series of proposed rules that would establish performance metrics required by MAP-21. Specifically, the administration has cleared rules and made effective the metrics outlined by the ‘Pavement/Bridge Condition Performance Measures’ proposed rule and ‘System Performance/Freight/CMAQ Performance Measures’ proposed rule.
These rules will take effect on May 20th, 2017, with the exception of certain portions of the rule pertaining to the measure on the percent change in CO2 emissions from 2017, generated by on-road mobile sources on the NHS (the GHG measure). While the published rule includes a GHG measure, the effective date of the portions of the final rule pertaining to that measure has been delayed indefinitely. In the Federal Register Notice the US Department of Transportation notes that it will be publishing an additional notice of proposed rulemaking to ascertain additional comments.
The US Department of Transportation plans on holding two webinars on this matter (see below). Participants are encouraged to submit questions by May 25 to Performancemeasuresrulemaking@dot.gov .
